“This confirms what people already think they know, that they’re going all out to stop [Thaksin]. I don’t think that it changes anything at all,” Montlake quoted Michael Montesano, a Visiting Fellow at the Institute for Southeast Asian Studies in Singapore.
“This verdict confirms the continuing role of the judiciary in resolving political crises in the country,” IPS quoted Thanet Aphornsuvan, a historian at Thammasat University. “The Supreme Court is being increasingly asked to play an important role, so I was not surprised by the verdict.”
Thanet once described this trend as a “judicial revolution.”
British academic Duncan McCargo said in an op-ed in The Independent, London, the next day: “Judicialisation of politics has been the major response of the royalist elite to the Thaksin ‘threat’. Constant recourse to the courts has undermined state legitimacy and infuriated Thaksin’s supporters.

“Judges have abolished a number of Thaksin-aligned political parties, banned most senior Thaksinite politicians from public life for five-year terms, and even ousted prime minister Samak Sundaravej for illegally hosting a television cookery show.”

Asia Times said: “The court-ordered seizure of Thaksin’s assets is in line with the gathering trend towards the ‘judicialization’ of Thai politics, ……where high courts and judges assume the role the monarchy has traditionally played in mediating the country’s complex and often heated political disputes.”
Bangkok Pundit preferred the term “judiocracy”. He viewed the powers that have been vested in the unelected judicial branch as too broad. “They are unaccountable,” he said. The judges “simply say we should trust them. However, this trust does not come with a right to open criticism as the judiciary is quick to make allegations of contempt. The judiciary can then jail and/or fine, and in essence, they act as judge, jury, and executioner. Yet at the same time this has not stopped the judiciary from making public comments criticizing politicians and the political system,” added Bangkok Pundit.
“What Thai people feel at the moment is that justice in this society is fading away,” said General Chavalit Yongchaiyudh, chairman of the pro-Thaksin Pheua Thai Party.

I am deeply disappointed and regretful that the Supreme Court ruled and ordered the seizure of over 46 billion Baht yesterday. My family and I have not received justice and wholly disagree with the decision which is against the laws and not based on facts. This case is politically motivated and was started after the Coup d’etat in 2006. The investigation and seizure of the assets were illegal and against the rule of law in any civilized country. As a matter of facts, the assets seized under the court order are lawfully, diligently and hard-earned assets that belong to my family. I had earned and acquired the assets well before I entered politics and before I became Prime Minister in 2001. Throughout my tenure as Thai Prime Minister, I devoted my time and energy and worked tirelessly for the benefits of Thailand. I have never done anything to benefit my family business. I had never become unduly rich. I feel as if my family and I had been robbed and harshly and unbearably treated.

Today is a historic day that shall long be remembered by Thai people and the whole world. The seizure of asset by the Asset Examination Committee appointed by the military junta is just part of a coordinated attempt to get rid of me by the elite and establishment, starting from the assassination attempt, staging a Coup d’etat, destroying my family, and asset seizure. I have not received justice. I do not accept the decision. I do not despair and I will not give up. I shall seek justice in every forum and opportunity that is open to me.

I never thought that the political persecution will be that cruel and cause grave consequences to my family and I. I feel bitter and hurtful as I sympathize towards my family and my children. They have to bear the consequences for what they as well I have never perpetrated. I love my family like other Thai do.

The court decision and what happens to my family and I are grave injustice. For those who love and sympathize towards me and for those who love justice that may feel bitter, hurtful, and angry, I urge you to be patient and to refrain from resorting to any violent means that may not only cause damage to our country but also play into the hands of the government that may use it as a pretext to crush the people.

I call upon those democracy and justice loving people to remain calm and not to use violent means to help me and my family, despite grave injustice on my family and I.I urge all of you to ponder and remember this incident as part of grave injustice that was committed against our country and people.  I call upon you to join the peaceful and non-violent struggle for true democracy and justice which I regard as being of paramount important to Thailand.

I am grateful for all moral support and sympathy sent to me and my family during this difficult time. Today is not my day. I shall continue my non-violent fight for true democracy and justice for our country and people. The day will soon come and it will be the day of ours.

Upon Hearing The Asset Case’s Result

Today has marked a history of Thailand’s justice system. The seized asset of more than 40,000 millions was done on a claim that I benefited from higher stock prices due to my being Prime Minister. The surplus was interpreted as wrongdoings, and was entirely seized. This must be a joke to the world. Stock rising as a result of my being Prime Minister? When stocks rise, the entire market does.

Does this resembles the dissolution of Thai Rak Thai Party? Court was used as a tool. Government was well-aware of the coming verdict. The flag pointer and the protector of this government are one same person. I foresaw this bashing. Only how. My conclusion at this point is: when the country’s economy improves, I receive no share. But when assets of my family increase, I am accused of cheating and my assets were seized. Fairly good that they return what was mine before the political years by using the price of stock even though it comes from the same amount of stock.

The whole stock market rises when it does. It is the country and global economic forces, not a result of my premiership. Other enterprises also benefit. Bangkok Bank, TPI, True, and PTT. This is most political. I put on a black suit today to mourn. I mourn my own stubbornness when I refused to listen to my wife and my children advising me not to enter politics. I want to serve my country. I feel the need to pay back my fellow citizens. Let me apologize to my family. Political life is real  tough. Let me be the very last victim of Thai politics. With true democracy, there will be no more victim.

Power rests with aristocrats, who constantly push the button. Law enforcement runs real fast with the opposite side. Serious lack of international standard. One person can yank the country backward. I wrote a dissertation on the Observation of the Rule of Law for my Ph.D. in Criminal Justice. But I receive no justice. I apologize to good judges who wish to uphold their institution, fearing it may all be destroyed. Because they want to get me, your institution was used for the purpose. I hope things start to get better after they did all they would to me.

I am a sensible person. If you don’t want me in politics, I will back down. I told His Majesty at one time I would not accept premiership. I announced most publicly in April 2006. Then the election was nullified, citing a laughable reason of voters having their backs outwardly. New election was set so far apart: December. They couldn’t wait so the coup it was. Prior to the coup, there were several attempts to assassinate me, which didn’t succeed. After the coup, this committee, comprised of my political enemies, was set up to make outrageous accusations of corruption. Now you can come to conclude that General Sondhi, the coup leader, was only a nominal leader. People’s Power Party won the election, to the aristocrats’ great disappointment. Prime Minister Samak was then gotten rid of. The party was also dissolved to get rid of another Prime Minister (Somchai Wongsawat).

Let me thank all of our supporters who adhere to my request not to show up during the case. You don’t want to be accused of doing all that for me. Let me face it alone. You can be angry, but with no violence. We must be patient and peace-oriented and continue to fight for democracy for future generations. For business people, do not enter politics. Business people are prone to get the job done. If you do that, my fate will be yours. If you really want to serve, sell everything before you step in.

I am the only Prime Minister who had been elected twice, consecutively. Let me say that all their accusations result from me performing my duties, systematically. I have no notion of cheating. Never thought of it. Never had a need to do so. And no need to be so greedy either. I put on one wrist watch at a time, not several. Why greedy? All charges of corruption were and are politically-motivated. My wife is a good teacher to our children. Never living in luxury. We no longer have to struggle. I just want to serve my country. I became the very first one whose personal assets were seized. If I had cheated, let me face death in 7-10 days. If I had not…let me cite this poem to you…

“This land bears witness.

We are student of great guru.

We do wrong, we deserve punishment.

We did not, but punished, may this sword be returned”.

I will continue to seek justice, wherever I am, in or out of the country. Today I receive no justice. Justice is to be sought. May the people judge. Look back at my years of service, not as one scene of a feature film. Look closely and you will see injustice lurking around. I will fight on peacefully. Future generations must be born to and in democracy, justice, and equality.

What has happened to me should be regarded as lessons for Thailand’s democratization. I appreciate all support and genuine concern. Again, I am sorry for my wife and my children.

วันนี้ถือว่าเป็นประวัติศาสตร์ทางการเมืองไทยและกระบวนการยุติธรรมไทย  ทรัพย์สินที่เขาสั่งยึดวันนี้สี่หมื่นกว่าล้าน  โดยอ้างว่าเป็นราคาหุ้นที่เพิ่มขึ้นหลังจากผมเป็นนายกฯ ราคาหุ้นก่อนเข้ามา 21 บาท พอครอบครัวผมขายได้ 49 บาท ตรงส่วนเกินที่เกิดขึ้น เขาบอกว่าผมใช้อำนาจหน้าที่ตอนเป็นนายกฯ เขาจึงยึดหมด คงเป็นที่ขบขันกันทั้งโลก  การที่หุ้นขึ้นทำให้ผมร่ำรวยเพราะการเป็นนายกรัฐมนตรี ใช้อำนาจของนายกรัฐมนตรี  แต่จริงๆแล้วหุ้นขึ้นทั้งตลาด

ฟังการอ่านวันนี้ คล้ายวันที่พรรคไทยรักไทยถูกยุบ ตั้งแต่ก่อนที่จะมีการปฏิวัติ ศาลถูกใช้เป็นเครื่องมือจัดการทางการเมือง และวันนี้ผู้พิพากษาบางกลุ่มก็เล่นการเมือง  วันนี้เป็นการเมืองร้อยเปอร์เซ็นต์

เมื่อวานเพิ่งพูดไปว่ารัฐบาลรู้ล่วงหน้าอยู่แล้ว เพราะคนปักธงกับคนอุ้มรัฐบาลเป็นคนเดียวกัน  ผมทำใจแล้วว่าโดนแน่  แต่จะโดนอย่างไร เมื่อโดนตรงนี้เข้า ก็สรุปได้ว่าการเป็นนายกรัฐมนตรี  ทำให้เศรษฐกิจดีขึ้น ทรัพย์สินประเทศเพิ่มขึ้น ไม่เห็นแบ่งผมเลย แต่หุ้นบริษัทครอบครัวผมขึ้น บอกว่าผมโกง

ยังดีที่ยังคืนในมูลค่าหุ้นส่วนก่อนเป็นนายกรัฐมนตรี ราคาหุ้นขึ้นลงตามดัชนีเศรษฐกิจและตลาดโลกเป็นส่วนใหญ่  ตอนนี้ผมไม่เข้าใจ ราหุ้นขึ้นเพราะผมเป็นนายกรัฐมนตรี มาโกงให้บริษัทตัวเอง  แล้วที่เหลือในตลาดหลักทรัพย์หุ้นเขาไม่ขึ้นกันหรือ ทั้งธนาคารกรุงเทพ  ทีพีไอ ปูนซิเมนต์ไทย  ยูคอม ทรู ก็ขึ้นกันทั้งนั้น ยอมรับเป็นการเมืองสุดๆ

จะเห็นว่าวันนี้ผมใส่ชุดดำ  ขอไว้ทุกข์ให้กับความดื้อของตนเองที่ดื้อไม่ยอมเชื่อ คุณหญิงกับลูกๆ ที่ไม่อยากให้ผมเข้าการเมือง ชีวิตการเมืองวุ่นวายสับสน เราเป็นเศรษฐีสบายอยู่แล้ว อย่าไปยุ่งการเมืองเลย  แต่การที่ผมเรียนเตรียมทหารและโรงเรียนนายร้อยตำรวจ  เติบโตมาจากบ้านนอก  ทำงานสร้างตัวมา เห็นคนยากจน ก็อยากจะช่วยเขาบ้างในฐานะเพื่อนร่วมชาติ ก็เลยดื้อกับคุณหญิง กับลูก พ่อขอโทษที่ทำให้ทุกคนเดือดร้อน

การเมืองวันนี้ดุและใจดำมาก  ผมขอให้ผมเป็นเหยื่อคนสุดท้าย  เมื่อใดที่ประเทศชาติเป็นประชาธิปไตยที่แท้จริงแล้ว อำนาจจะมีการถ่วงดุล  คงจะไม่มีเหยื่ออย่างผมอีก แต่วันนี้ดุลอำนาจไปอยู่กับอำมาตย์

กฎหมายวันนี้เหมือนเล่นติ๊ต่าง  ถ้าเป็นพวกอำมาตย์  ทำสำนวนแล้วยังดึงเรื่องไปได้เรื่อย แต่ถ้าไม่เป็นพวกอำมาตย์  กฎหมายก็จะเดินไปอย่างรวดเร็ว  กฎหมายไทยเช่นนี้ขาดมาตรฐานสากลอย่างรุนแรง  มีคนเพียงคนเดียว  กระชากประเทศล้าหลังอย่างรุนแรงมาก

ผมเป็นนักเรียนทุนรัฐบาล ที่ไปเรียนปริญญาโทและเอกทางด้านกระบวนการยุติธรรมในทางอาญา  ทำวิทยานิพนธ์เรื่องหลักนิติธรรม  ปรากฏผมเป็นเหยื่อของกระบวนการยุติธรรมและทำกับผมอย่างขาดหลักนิติธรรมอย่างที่สุด

ผมต้องขอโทษผู้พิพากษาที่มีอุดมการณ์  ไม่อยากเห็นสถาบันที่ท่านรักต้องเป็นแบบนี้  ก็เพราะเขาต้องการจัดการผม  จึงดึงสถาบันของท่านลงมา หวังว่าทุกอย่างจะดีขึ้นหลังจากที่เขาทำผมถึงที่สุดแล้ว

ผมเป็นคนพูดรู้เรื่อง  ไม่อยากให้ผมเล่นการเมือง  ผมก็พร้อมถอย  ผมเคยกราบบังคมทูลพระบาทสมเด็จพระเจ้าอยู่หัวไปแล้วว่าจะไม่รับตำแหน่ง เคยประกาศหน้าทำเนียบเมื่อเดือนเมษายน 2549  ผมประกาศว่าจะไม่รับตำแหน่งนายกรัฐมนตรี แต่การเลือกตั้งครั้งนั้นเป็นโมฆะเพราะหันหลังออก หาว่าไม่ยุติธรรม ไม่ยุติธรรมเพราะกล้องทีวีไปถ่ายในคูหา  เป็นประวัติศาสตร์การเมืองไทยที่ยุบสภาไปแล้ว  กว่าจะได้เลือกตั้งยืดเวลาทอดไปถึงธันวาคม  แต่เขารอไม่ไหว ปฏิวัติก่อน  ซึ่งก่อนหน้านั้นลอบฆ่าผมหลายครั้ง  จากนั้นเขาก็ตั้ง คตส. มา  วันนี้ถ้าได้เปอร์เซ็นต์ถือว่าปล้นทรัพย์

การปฏิวัตินั้น  สนธิบังแค่หุ่นเชิด  คนปักธงคือคนปฏิวัติ

การที่ยืดเยื้อ จัดการไม่เสร็จสักที  เพราะพี่น้องเมตตาช่วยเหลือ  เริ่มจากการเลือกตั้งที่พรรคพลังประชาชนชนะเลือกตั้ง คุณสมัครเข้ามา  แต่ผลสุดท้ายเขาก็จัดการคุณสมัคร  ตามด้วยการยุบพรรคพลังประชาชน แล้วก็ตั้งรัฐบาลตามที่เขาต้องการ

ผมขอบคุณที่พี่น้องเสื้อแดงที่ไม่มาชุมนุม  ไม่เช่นนั้นท่านจะถูกกล่าวหาว่ามาทำเพื่อผม  ทั้งที่พี่น้องมากันเพื่อประชาธิปไตย  ขอให้วันนี้เป็นเรื่องของผมล้วนๆ  หลายคนอาจโกรธแทนผม  โกรธได้แต่อย่างใช้ความรุนแรง อย่าไปทำเหตุให้เขาปราบปราม รัฐบาลนี้ถนัดอยู่แล้ว พี่น้องต้องอดทน ต่อสู้ด้วยสันติให้ได้มาซึ่งประชาธิปไตยเพื่อลูกหลานของเรา  ไม่เช่นนั้นประเทศจะอยู่ในมืออำมาตย์  ไม่พอใจใครก็สามารถจัดการได้  เป็นประเทศที่ไม่สามารถทำนายอนาคตได้ แล้วประเทศจะอยู่อย่างไร

นักธุรกิจครับ  บทเรียนวันนี้บอกได้เลยว่าอย่ามาเล่นการเมือง  นักธุรกิจมีนิสัยทำงานให้สำเร็จรวดเร็ว  มันคนละวัฒนธรรม  มีอะไรเข้ามา ท่านอาจโดนยึดทรัพย์อย่างผม  ถ้าจะเข้าการเมืองจริงๆ ขายให้หมดก่อน  อำมาตย์เขาไม่รังเกียจเรื่องทุจริต  แต่อย่าป็อปปูล่าร์มาก ผมเป็นนายกรัฐมนตรีคนเดียว คนแรกที่ได้รับเลือกตั้งในสมัยที่สอง ปกติไม่มี  เขาไม่อยากเห็นรัฐบาลที่ป็อปปูล่าร์

พี่น้องชาวไทยทุกท่าน  กราบเรียนว่าสิ่งที่เขาประณามผมวันนี้  ผมขอยืนยันว่าทำงานตามหน้าที่ทั้งระบบ ไม่เคยคิดโกง ตั้งแต่เด็กก็ไม่เคยโกง ไม่เคยลอกข้อสอบใคร ไม่มีความจำเป็นต้องโกง ผมมีหลักทรัพย์มาก่อนเป็นนักการเมือง เคยประกาศบัญชีทรัพย์สิน ปี 2537 ผมมี 60,000 กว่าล้าน   ไม่จำเป็นต้องโลภมาก  นาฬิกาก็ใส่ทีละเรือน  กินทีละมื้อ กินก๋วยเตี๋ยวได้ทุกมื้อ  แต่หูฉลามทุกมื้อไม่ได้  คนเราจะโลภไปถึงไหน   คุณหญิงสอนลูกดี ลูกไม่ฟุ่มเฟือย  จึงไม่มีความจำเป็นที่ต้องดิ้นรนไปคดโกงใคร เราสบายแล้วก็ควรใช้ความรู้ความสามารถช่วยเหลือเพื่อนร่วมชาติที่ยังจนอยู่

ผมเป็นคนแรกที่ถูกยึดทรัพย์ส่วนตัว ทรัพย์ของครอบครัวเพื่อสังเวยการเมือง  วันนี้เป็นประวัติศาสตร์  ผู้ชนะเป็นคนเขียน  วันนี้ผมไม่ใช่ผู้ชนะ  แต่จะบันทึกประวัติศาสตร์นี้ไว้

ถ้าผมโกงหรือทำอย่างที่เขากล่าวหา  ขอให้มีอันเป็นไปในเจ็ดวันสิบวัน  หากไม่โกง  ขอฝากโคลงศรีปราชญ์  …

ธรณีนี่นี้เป็นพยาน      เราก็ศิษย์มีอาจารย์หนึ่งบ้าง

เราผิด ท่านประหารเราชอบ

เราบ่ผิด ท่านมล้าง ดาบนั้นคืนสนอง…

ผมเคยบอกว่าจะแสวงหาความยุติธรรมให้ได้  ไม่ว่าความยุติธรรมนั้นจะอยู่ในนรกหรือ สวรรค์ ในหรือนอกประเทศ ผมถือว่าวันนี้ผมไม่ได้รับความยุติธรรม ผมจะแสวงหาต่อไป

ขอให้ทุกท่านใช้วิจารณญาณต่อไป  อย่าดูหนังม้วนเดียว  ขอให้ดูย้อนไปตั้งแต่ผมทำงานมาเป็นอย่างไร  แล้วก่อนถูกปฏิวัติเจออะไร  มีการใช้สถาบันต่างๆ เข้ามาจัดการการเมืองอย่างไร ศึกษาให้ดีแล้วจะรู้ว่าสิ่งที่เกิดขึ้นในบ้านเราไม่ปกติ  ขอให้พี่น้องผู้รักประชาธิปไตยต่อสู้ต่อไปด้วยสันติ อนาคตลูกหลานของเราจะเติบโตมาในสังคมประชาธิปไตย  ที่มีความยุติธรรมและความเสมอภาค

ขอให้สิ่งที่เกิดขึ้นกับผมวันนี้ ขอให้เป็นบทเรียนที่ดีสำหรับการเมืองไทยที่จะพัฒนาต่อไป  ผมเจ็บคนเดียวไม่เป็นไร  ขอขอบคุณทุกท่านที่เป็นห่วงและอวยพรผมมา  ขอขอบคุณในน้ำใจที่ผมจะไม่มีวันลืม  ขอโทษคุณหญิงและลูกที่ผมดันทุรังเข้าการเมือง เสียใจครับ ขอบคุณครับ
